Terms & Conditions
Booking Information:
1. Booking fee of £40 (£50 for bookings totalling over £180) and your booking
forms signed and completed will secure your party date; by paying the
booking fee the Hirer will be agreeing to the Terms and conditions set out
below.
2. The ‘Hirer’ means the person signing the booking form for ‘Hire of
equipment’.
3. Damage deposit of £50 is due in cash on the day of set up, this will then be
returned on collection and inspection of all items.
4. Any damage that occurs to our equipment which total’s less than £50 will deducted before the remainder of deposit is returned to Hirer.
5. Any damage that occurs to our equipment which total’s more than £50 will be invoiced to the Hirer and expected to be paid within 3days of invoice being sent. Legal action will be sought should non-payment occur.
6. Final balances are required no less than 14 days prior to the party. BACS payment only. Payment/ bank details can be found within your booking document.
7. The final numbers and choices must be confirmed at least 14 days prior to the date of the booking. Any booking reductions after this time will still be charged for at the previous rate, with no refunds due.
8. The Hirer is responsible for providing Violet Hummingbird Events with all relevant medical/dietary information for all the children attending the party. Violet Hummingbird Events will take no responsibility for allergies or illness (including skin, food etc) during or after the event. It is the Hirers responsibility to ensure full parental consent of each child is gained to attend the event and any allergies or special requirements are documented in the booking documentation and returned back to Violet Hummingbird Events.
Violet Hummingbird Events is likewise not responsible at any point, for the welfare of the children at the parties, this remains the full responsibility of the hirer.
9. The Hirer is responsible for ensuring the accuracy of the information given to Violet Hummingbird Events and to pass over such information in sufficient time for Violet Hummingbird Events to perform the contract safely and
without risk, within 14 days of the event occurring, to avoid last minute disappointment.
10. Violet Hummingbird Events reserves the right to make any changes to the services as is deemed reasonably necessary by Violet Hummingbird Events without notice to the Hirer. If the required service is less than originally requesting the requisite refunds will be made to the Hirer.
11. The Hirer is responsible/ liable for any damage or injury occurring from or as a result of inappropriate use or misuse or reckless use of any of Violet Hummingbird Events equipment.
12. It is the Hirers responsibility to ensure that the children are supervised at all times. Violet Hummingbird Events will charge the hirer for the costs of any damage to any property caused by your breach of this clause.
13. It is the Hirers responsibilities to ensure the children comply with all reasonable instructions from Violet Hummingbird Events to ensure the safety of the attendees and other persons present. Violet Hummingbird Events may suspend the event if you are in breach of this clause.
14. Violet Hummingbird Events will accept no liability or responsibility to the Hirer for any damages, costs, losses, claims, expenses, demands and proceedings including property of Hirer and their guests, or any consequential
loss in these regards.
15. Violet Hummingbird Events shall use all reasonable endeavours to provide the services in accordance with the contract and shall perform the services with reasonable skill, care and diligence and in accordance with all health and
safety regulations in force at this time.
16. Violet Hummingbird Events shall process all data in accordance with the Data Protection Act 2018 which include the new rules on GDPR.
17. It is not the intention of Violet Hummingbird Events to violate any copyright laws and all themes are only inspired by popular trends.
Supervision:
1. The Hirer is responsible for the care and safety of all the children and should ensure that all parent/guardians are aware that Violet Hummingbird Events is not responsible for the care and safety of their children. It is also the Hirers
responsibility to inform parents of all activities included within the event package provided by Violet Hummingbird Events to ensure full parental consent and reduce the risk of allergies/ harm.
2. The Hirer will be required to take responsibility for all children that have been left by their parent/guardian.
3. We would recommend that the Hirer of the party take contact telephone numbers of the children attending if their parent/guardian is not staying at the same time as clarifying any medical/allergic conditions.
4. Whilst we love our furry friends, we do ask in the interest of health and hygiene that domestic pets are not allowed access to the hire equipment. Any additional cleaning/damage as a result of access to the equipment by pets may result in an additional charge, particularly any excess pet hair.
Cancellation: (by the Hirer)
In the unfortunate event the hire is cancelled the following refund policy will be applied:
1. If you the Hirer needs to cancel prior to 14 days any payment made will be refunded – minus a £20 booking fee which as previously stated is non-refundable this is to cover admin costs.
2. If the Hirer needs to cancel a booking less than 13 – 8 clear days prior to the party date hirer will receive 50% refund minus the £20 non-refundable booking fee.
3. If cancellation is less than 7 days, then hirer will be offered an alternative date this is subject to availability. Credit is valid for 6 months from the date of original booking.
4. Government guidelines have changed and therefore self-isolation is not mandatory and only recommended. If you do contract Covid leading up to your event date, then we do ask that you let us know. We would also ask that your booking is postponed this is to keep us safe and allow us to carry on working and running our business safely. If you wish to cancel then no refund will be given, and a credit note valid for 6 months from the date of your original booking will be issued.
Cancellation (by Violet Hummingbird Events):
1. Violet Hummingbird Events reserves the right to cancel the booking at any time for any reason, in the event of emergencies this may be required. Violet Hummingbird Events will try to give as much notice as possible and source
other reputable companies who could potentially carry out the booking depending on availability.
2. Full refund will be given if a suitable alternative date cannot be mutually agreed in the event of Cancellation by Violet Hummingbird Events due to Covid-19.
3. Upon any such cancellation Violet Hummingbird Events will refund to the Hirer any monies paid to Violet Hummingbird Events in respect of the booking, but Violet Hummingbird Events will not be liable to pay any compensation to the Hirer or any other person for any loss, damage or expenditure arising directly or indirectly from the cancellation.
4. Violet Hummingbird Events reserves the right to terminate the booking without notice if there is a breach of these any of these conditions set out in this booking form.
Liability
1. Nothing in these terms shall limit or exclude the liability of Violet Hummingbird Events which may not be limited or excluded by law, including without limitation liability for death or personal injury caused by Violet Hummingbird Events negligence or fraudulent misrepresentation.
2. Subject to the above Violet Hummingbird Events shall have no liability (whether arising under contract, tort, or for breach of statutory duty or otherwise) to the extent that such liability would not have arisen but for the Hirer’s breach of the contract.
3. Subject to the above clauses Violet Hummingbird Events aggregate liability for all claims in relation to the contract (whether arising under contract, tort, or for breach of statutory duty or otherwise) shall not exceed the price paid by the Hirer.
4. This contract is governed and construed in accordance with English law and the parties irrevocably submit to the exclusive jurisdiction of the courts of England.
5. Under no circumstances is our equipment to be sub-let to any other persons or companies, all equipment is to remain in the hirers address where booking was agreed and set up took place.
6. No information included in this booking form will be disclosed to any third party (see privacy policy).
7. It is the responsibility of the Hirer to inform guests accordingly of the above terms and conditions.
8. Violet Hummingbird Events has suitable public liability insurance and takes the upmost care to ensure the safety of all-party guests at all times. Violet Hummingbird Events tents and canopies are independently tested and marked CE/UKCA in accordance with the Toy Safety Regulations UK 2011.
9. We use high quality products and follow strict hygiene routines. If you would like to see our Covid-19 method statement this can be sent on request.
10. Liability cannot be taken for reactions or injury sustained whilst attending a party or thereafter.
11. All persons using Violet Hummingbird Events equipment do so at their own risk and it is the party hirer who is responsible / liable for any damage or injury occurring from or as a result of inappropriate use or misuse or reckless use.
12. This information is given for the safety of all people attending a party hired from Violet Hummingbird Events and it is the sole responsibility of the Hirer to ensure that they are understood and adhered to by all party guests invited.
13. Any inadvertent delay, omission, or error in complying with the terms and conditions of this Contract shall not be held to relieve either party hereto from any liability, which would attach to it hereunder if such delay, omission, or error
had not been made, provided such delay, omission, or error is rectified upon discovery.
